How to Protest Property Taxes
in Collin County
To protest your property taxes in Collin County, follow these steps:
1. File a Notice of Protest Form (Form 50-132)
There are three ways to file the Notice of Protest: 1) Online Appeals website, 2) by mail, or 3) in person. Collin Central Appraisal District (Collin CAD) encourages homeowners who have a pin on their Notice of Appraised Value to efile on the Online Appeals website.
You’ll need to provide owner and property information and protest reasons, and you’ll also need to select the type of hearing you want.
With exception, the deadline to file a Notice of Protest is May 15.
2. Prepare Evidence
You’ll need to prepare evidence that supports your lower value, such as sale prices of comparable properties, property damage, inaccurate data on your Notice of Appraised Value, etc. You can also ask Collin CAD for the information they used in their assessment. Review that information for discrepancies or inaccuracies.
Each CAD defends its value differently. All residential protests come down to these two elements: Adjustment Calculations and Comparable Selection. Be sure to confirm whether or not the comparables used against you are something you would have considered purchasing at the time you bought your home. Collin CAD uses land adjustments, neighborhood adjustments, and depreciation adjustments to their advantage.
3. Resolve with an Informal Review
An informal hearing can be done on the phone, online, or in person. If you and the appraiser agree to a value, there is nothing further you will need to do. However, you must be willing to waive your rights to any further appeal should you change your mind.
4. Attend an ARB Hearing
A formal hearing with the Collin Appraisal Review Board (ARB) is an option if you can’t reach a resolution through an informal hearing, as long as you filed by the protest deadline.
The hearing can be done in person, by telephone, or by video conference. Keep in mind that you need to submit your request in writing at least 10 days before the hearing if it will be by telephone or video conference. If you choose one of these hearing types, you must provide your evidence by affidavit or written declaration.
These restrictions make it critically important to request and enforce the rule of 14-day evidence. The CAD must deliver the evidence they intend to present at hearing. They are not allowed to present anything else.
After your hearing, the ARB will send their decision to you by certified mail. If you are not satisfied with their decision, you must take your case to binding arbitration.
5. Appeal through District Court or Binding Arbitration
You must file a petition for district court or binding arbitration within 60 days of receiving the ARB’s decision. You will also have to make a partial payment on your property taxes if you go to district court.
Binding arbitration is an alternative and is informal compared to district court. The arbitrator’s decision is final. If you win, the appraisal district will pay the arbitrator’s fee. If the property value is closer to the ARB’s value, you will pay the arbitrator’s fee.
There is a third appeal option through the State Office of Administrative Hearings for residential properties valued over $1 million. Similar to binding arbitration and district court, there is a fee associated with this appeal type.
